Through this Electronic Disclosure Agreement ("E-SIGN Consent"), you agree to (1) electronically receive Communications from TFLI (US) Inc. ("we," "us," "our") pursuant to the terms set forth herein and (2) electronically sign agreements, as necessary. "Communications" means any and all disclosures or other information that we provide to you in connection you're your relationship with us which may include information applicable laws or regulations require we provide you in writing.
This E-SIGN Consent is effective immediately. If we will provide Communications to you via email, we will ask you to confirm your E-SIGN Consent by email and your E-SIGN Consent for Communications by email will not be effective until you have confirmed your E-SIGN Consent. Your E-SIGN Consent expires when it is revoked by you or terminated by us.
You are not required to provide E-SIGN Consent; however, failure to do so means you cannot execute your transaction with us online. If you provide E-SIGN Consent but would also like a paper copy of any Communication, please contact us at the address below. If you withdraw your E-SIGN Consent, or do not confirm your E-SIGN Consent in connection with email Communications, we may deliver Communications to you by paper delivery. We may charge a reasonable service fee not to exceed $5 (USD) for paper delivery of any Communication.
We will deliver electronic Communications by making the electronic Communications viewable to you online. We may also send you Communications by email to the email address we have on file for you. We recommend that you print a paper copy of any electronic Communications for your records. You agree that you can access, view, download, save, and print any Communications you receive via electronic delivery for your records.
You understand that your use of a keyboard, mouse, or other device to select an item, button, icon, or similar action, or to otherwise provide your assent during your transaction with us constitutes your signature and acceptance and is the legal equivalent of your physical signature.
You understand that in order to receive electronic Communications and provide your electronic signatures on our website, you must have internet access, a supported operating system (most recent version of Windows, Mac OS, Android or iOS), and a supported web browser (most recent version of Edge, Chrome, Firefox, or Safari). You also understand that in order to receive electronic Communications from us by email, you must have internet access, an email account capable of receiving HTML-based email messages, a way to view and interact with such account which may include browser access or an email client application, and a device compatible with such method of access. Please contact your email provider for more information about requirements to receive and send emails from your account. Your receipt and acceptance of this E-SIGN Consent demonstrates that you can access the information contained herein and the Communications.
You acknowledge that the Internet is not a secure network and that electronic Communications transmitted over the Internet may be accessed by unauthorized or unintended third parties. Although we have implemented reasonable technical safeguards to protect our communication systems from unauthorized access, we cannot guarantee network security and you accept that receiving or sending Communications via the Internet is at your own risk.
